INTRODUCTION
Thank you for choosing AGAPOV & ARNO.
We believe that every photography session is built on trust, clear communication, and shared expectations.
These Terms & Conditions explain how we work, what you can expect from us, and what we ask from our clients in return. They are designed to protect both you and our studio while helping ensure that every project runs smoothly from the first inquiry to the final delivery.
By booking our services, purchasing our products, or using our website, you agree to these Terms & Conditions.
If you have any questions, we encourage you to contact us before making a booking.
1. ACCEPTANCE OF THESE TERMS
These Terms & Conditions apply to all photography sessions, creative services, products, memberships, subscriptions, workshops, consultations, digital content, and any other services provided by AGAPOV & ARNO unless otherwise agreed in writing.
By submitting a booking request, paying a booking fee, purchasing a product, signing a quotation or agreement, or otherwise engaging our services, you acknowledge that you have read, understood, and accepted these Terms & Conditions.
If any provision of these Terms & Conditions is found to be unenforceable, the remaining provisions shall remain in full force and effect.
2. ABOUT AGAPOV & ARNO
AGAPOV & ARNO is the creative brand operated by Agapov Production, a Swiss sole proprietorship (Einzelunternehmen) registered in Switzerland.
We provide photography, creative direction, visual storytelling, and related creative services for both private individuals and commercial clients.

As our studio evolves, we may introduce additional services without requiring these Terms & Conditions to be rewritten. Unless otherwise stated, these Terms shall apply to all future services.
3. OUR SERVICES
Every project is unique.
For this reason, all photography sessions and creative services are planned individually according to the client's needs, the selected package, location, creative concept, and any additional services requested.
Descriptions of services, packages, pricing, products, and availability published on our website are provided for general information and may be updated or modified without prior notice.
Booking requests submitted through our website do not constitute a confirmed reservation.
A booking becomes confirmed only after it has been accepted by AGAPOV & ARNO and any required booking fee or other agreed payment has been received.
We reserve the right to decline booking requests where appropriate, including situations involving scheduling conflicts, unavailable dates, safety concerns, or other reasonable business considerations.
4. BOOKING & CONTRACT FORMATION
Clients may submit booking requests through our website, email, telephone, social media, or any other communication channels provided by AGAPOV & ARNO.
Submitting a booking request does not automatically guarantee availability or create a binding agreement.
A contract is considered formed only when:

the requested booking has been accepted by AGAPOV & ARNO;

any required booking fee has been received (where applicable); and
-
both parties have confirmed the essential details of the project.
A confirmed booking reserves the agreed date and time exclusively for the client.
Any significant changes requested after confirmation—including location, package, duration, or other essential project details—may require additional fees or a revised agreement.
We reserve the right to refuse or cancel a booking where necessary for legitimate business, legal, or safety reasons.
5. PRICING & PAYMENT
All prices are listed in Swiss Francs (CHF) unless stated otherwise.
Prices published on our website may be updated from time to time without prior notice. However, confirmed bookings will remain subject to the pricing agreed at the time of confirmation unless both parties agree otherwise.
Some bookings may require a non-refundable booking fee to secure the selected date. Unless otherwise agreed, no booking is guaranteed until the required payment has been received.
The remaining balance, where applicable, must be paid according to the agreed payment schedule.
We accept payment using the payment methods made available by AGAPOV & ARNO, including online payment providers, bank transfer, and other approved payment methods.
Late payments may result in delays to editing, gallery delivery, product production, or the release of final images until outstanding balances have been paid in full.
If payment remains overdue, AGAPOV & ARNO reserves the right to charge any applicable reminder fees, statutory interest, collection costs, or other legally recoverable expenses permitted under Swiss law.
Any taxes, duties, shipping costs, or additional third-party charges not explicitly included in the agreed price remain the responsibility of the client unless otherwise confirmed in writing.
6. RESCHEDULING, CANCELLATION & NO-SHOW
We understand that unexpected situations may arise. Whenever possible, we will do our best to accommodate reasonable requests to reschedule a session.
Requests to reschedule should be made as early as possible.
Rescheduling is subject to photographer availability and cannot be guaranteed.
Any booking fees already paid will be handled in accordance with the agreed booking terms and may be transferred to a new date where appropriate.
Repeated rescheduling requests may require a new booking fee or additional charges.
If a client cancels a confirmed booking, any payments already made may be non-refundable unless otherwise agreed or required by applicable law.
Failure to attend a scheduled session without prior notice ("No-Show") may result in the loss of the reserved session and any payments already made.
If AGAPOV & ARNO is unable to perform the agreed services due to circumstances within our control, we will work with the client to arrange an alternative date or provide an appropriate solution.
Additional cancellation and rescheduling conditions may apply to specific services, memberships, workshops, Photo Days, subscriptions, gift cards, or promotional offers.
7. WEATHER, ILLNESS & FORCE MAJEURE
Outdoor photography sessions are naturally affected by weather conditions.
If weather conditions, lighting, safety concerns, or other environmental factors make it unreasonable to proceed with a session, AGAPOV & ARNO may recommend postponing the session to another mutually agreed date.
Neither party shall be considered in breach of these Terms if performance becomes impossible or significantly affected by events beyond reasonable control, including but not limited to:

severe weather;

natural disasters;
-
government restrictions;
-
war;
-
civil unrest;
-
public health emergencies;
-
transportation disruptions;
-
serious illness;
-
accidents;
-
power outages;
-
equipment theft;
-
other unforeseen circumstances.
Where possible, both parties will cooperate in good faith to arrange an alternative solution.
8. SESSION EXPERIENCE & CLIENT RESPONSIBILITIES
Creating meaningful photographs is a collaborative process.
Clients agree to provide accurate information regarding the booking and to cooperate throughout the planning and photography session.
Clients are responsible for arriving on time, informing us of any relevant changes, and following reasonable preparation guidance where provided.
If delays caused by the client significantly reduce the available session time, AGAPOV & ARNO may be unable to extend the session beyond the originally scheduled time.
Clients remain responsible for obtaining any permissions required for private locations, venues, or restricted areas unless otherwise agreed.
Where transportation, parking fees, entrance fees, permits, accommodation, or similar expenses are required, responsibility shall be determined according to the agreed quotation or booking confirmation.
AGAPOV & ARNO cannot guarantee specific poses, expressions, cooperation of children, weather conditions, or other circumstances beyond our reasonable control.
Client Conduct
AGAPOV & ARNO reserves the right to terminate a session without refund if a client or participant engages in abusive, threatening, unsafe, discriminatory, illegal, or otherwise inappropriate behaviour that places any member of our team or other participants at risk.
9. CHILDREN & SAFETY
The safety and wellbeing of every client, especially children, is always our highest priority.
Parents or legal guardians remain fully responsible for supervising children throughout the photography session.
AGAPOV & ARNO will never require a child to participate in any activity that may reasonably be considered unsafe or inappropriate.
If, in our professional judgment, a location, activity, weather condition, or other circumstance presents an unacceptable safety risk, we reserve the right to modify, relocate, postpone, or discontinue the session.
Clients are responsible for informing us of any medical conditions, allergies, accessibility requirements, or other circumstances that may reasonably affect the safety or planning of the session.
10. CREATIVE DIRECTION & ARTISTIC STYLE
Clients choose AGAPOV & ARNO based on our artistic style, creative vision, and portfolio.
By booking our services, clients acknowledge that they are familiar with our photographic style and understand that every project is created using our professional artistic judgment.
While we welcome ideas, inspiration, and creative preferences, all decisions regarding composition, lighting, posing, camera angles, editing, retouching, image selection, colour grading, cropping, and overall artistic presentation remain at the discretion of AGAPOV & ARNO.
No two photography sessions are identical, and we do not guarantee that any photograph will exactly replicate images previously created, inspiration images, Pinterest references, or examples from our portfolio.
Our goal is to create photographs that reflect the unique people, relationships, and story of each client rather than reproducing another session.
Creative differences or personal artistic preferences shall not be considered a defect in the services provided.
Client Satisfaction
We are committed to delivering work of the highest professional standard and always strive to exceed our clients' expectations.
However, artistic style is inherently subjective. Differences in personal taste, creative preference, or aesthetic opinion shall not, by themselves, constitute grounds for refunds, reshoots, or claims that the services were not performed satisfactorily.
11. IMAGE SELECTION & EDITING
Image selection is an important part of our creative process.
Unless otherwise agreed, AGAPOV & ARNO will carefully review all photographs captured during a session and determine which images meet our artistic and technical standards.
Images that do not meet these standards—including photographs affected by motion blur, closed eyes, test shots, duplicate frames, or other technical or artistic considerations—may be excluded from the final gallery at our sole discretion.
Editing and retouching are performed in accordance with the artistic style of AGAPOV & ARNO.
Unless expressly included in the selected package or agreed in writing, extensive retouching, body reshaping, object removal, background replacement, or other advanced image manipulation services are not included.
Additional editing requests may be available for an additional fee.
RAW files, unedited images, proof files, and original camera files remain the property of AGAPOV & ARNO and are not delivered unless expressly agreed in writing.
12. DELIVERY TIMES
Estimated delivery times are provided in good faith but are not guaranteed unless expressly agreed in writing.
Delivery times may vary depending on:

season;

project complexity;
-
image quantity;
-
additional products ordered;
-
client response times;
-
workload;
-
circumstances beyond our reasonable control.
Digital galleries, albums, prints, wall art, and other products will be delivered after all required payments have been received.
If client approval or selections are required during the production process, delivery times may be extended accordingly.
AGAPOV & ARNO shall not be responsible for delays caused by third-party suppliers, laboratories, shipping companies, or circumstances outside our reasonable control.
13. PRINTS, ALBUMS & PHYSICAL PRODUCTS
Where physical products are ordered, every reasonable effort will be made to ensure they meet our quality standards.
Colours, textures, materials, and finishes may vary slightly due to differences in printing processes, display calibration, paper types, lighting conditions, or manufacturing methods.
Such variations do not constitute defects.
Production and delivery of physical products may be carried out by trusted third-party laboratories or manufacturers.
AGAPOV & ARNO remains responsible for coordinating your order but cannot guarantee production or shipping times controlled by independent suppliers.
Clients should inspect physical products promptly upon delivery and notify us within a reasonable period if any manufacturing defect is discovered.
14. MEMBERSHIPS, SUBSCRIPTIONS & CLIENT PROGRAMS
AGAPOV & ARNO may offer memberships, subscription plans, loyalty programs, or other recurring client experiences.
Each program may be subject to additional terms specific to that offering.
Unless otherwise stated, memberships are personal and may not be transferred to another individual without our prior written approval.
Included sessions, products, discounts, or other benefits are intended to be used within the applicable membership period.
Unused benefits generally expire at the end of the applicable term unless expressly stated otherwise.
Membership fees, renewal conditions, cancellation policies, and any applicable payment schedules will be communicated as part of the individual membership agreement.
15. THIRD-PARTY SERVICE PROVIDERS
Some projects may involve independent third-party professionals or suppliers, including but not limited to:

videographers;
-
makeup artists;
-
hairstylists;
-
florists;
-
stylists;
-
designers;
-
decorators;
-
assistants;
-
laboratories;
-
printers;
-
delivery companies;
-
venues;
-
other specialist service providers.
Depending on the project, these services may either be arranged directly by the client or coordinated by AGAPOV & ARNO on the client's behalf.
Where AGAPOV & ARNO coordinates third-party services, we act as the project organizer and make reasonable efforts to select trusted professionals.
However, independent contractors remain solely responsible for the services they provide, including their professional performance, scheduling, products, legal compliance, insurance, and business practices.
AGAPOV & ARNO shall not be liable for the independent acts, omissions, delays, defects, cancellations, or failures of third-party providers beyond our reasonable control.
16. CLIENT GALLERIES & DIGITAL DOWNLOADS
Digital galleries may be provided through secure online gallery platforms or other digital delivery methods chosen by AGAPOV & ARNO.
Gallery availability may be limited in time.
Clients are encouraged to download all purchased images promptly after delivery.
While we may retain archived copies for a period of time, we do not guarantee permanent storage of delivered photographs.
Replacement downloads, gallery restoration, or retrieval of archived files may be available where technically possible and may be subject to an additional fee.
Clients are responsible for maintaining their own backups after successful delivery.
17. GIFT CARDS
Gift cards or gift certificates issued by AGAPOV & ARNO may be redeemed only in accordance with their stated terms.
Unless otherwise specified, gift cards:

cannot be exchanged for cash;
-
are non-refundable;
-
may not be combined with certain promotional offers;
-
may be subject to expiration dates where permitted by applicable law.
Lost, stolen, damaged, or unauthorized gift cards may not be replaceable.
Gift cards may not be resold without our written consent.
18. LIMITATION OF LIABILITY
AGAPOV & ARNO shall perform all services with reasonable professional skill and care.
To the maximum extent permitted by applicable law, our liability shall be limited to the amount actually paid by the client for the specific services giving rise to the claim.
We shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, emotional distress, loss of business opportunities, or loss of data.
Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law, including liability for intentional misconduct or gross negligence where required by law.
Clients acknowledge that photography is an artistic service and that reasonable creative differences, environmental conditions, participant cooperation, or unforeseen circumstances shall not constitute a breach of contract.
Equipment Failure
In the unlikely event of equipment failure, data corruption, or other technical circumstances beyond our reasonable control, AGAPOV & ARNO shall make reasonable efforts to provide an appropriate solution, which may include rescheduling the session, repeating the affected portion of the project where reasonably possible, or providing an appropriate refund limited to the affected services.
19. INTELLECTUAL PROPERTY
Unless otherwise agreed in writing, all photographs, videos, designs, artwork, concepts, layouts, educational materials, website content, branding elements, and other creative works produced by AGAPOV & ARNO remain our intellectual property.
The purchase of photography services or products does not transfer copyright ownership.
Clients receive only the rights expressly granted under the applicable License & Copyright Policy.
Detailed information regarding copyright ownership, licensing, permitted use of photographs, commercial use, social media sharing, publication rights, artificial intelligence, and image licensing is provided separately in our License & Copyright Policy.
20. PRIVACY
Your privacy is important to us.
The collection, use, storage, sharing, and protection of your personal information are governed by our separate Privacy Policy, which forms an integral part of these Terms & Conditions.
By using our services, you acknowledge that you have read and understood our Privacy Policy.
If there is any conflict between these Terms & Conditions and the Privacy Policy regarding the processing of personal information, the Privacy Policy shall govern those matters.
21. GOVERNING LAW
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Switzerland, without regard to its conflict of law principles.
To the extent permitted by applicable law, the courts having jurisdiction over the registered place of business of Agapov Production shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms & Conditions or the services provided by AGAPOV & ARNO.
Nothing in these Terms limits any mandatory consumer rights that may apply under applicable law.
22. CHANGES TO THESE TERMS
AGAPOV & ARNO may update these Terms & Conditions from time to time to reflect changes in our services, business operations, legal requirements, pricing structure, or other business developments.
The most current version will always be published on our website together with the updated "Last Updated" date.
Changes will apply only to future bookings unless otherwise required by applicable law or expressly agreed with the client.
We encourage clients to review these Terms periodically to remain informed of any updates.
Continued use of our website or services after updated Terms have been published constitutes acceptance of those changes where permitted by applicable law.
