PRIVACY POLICY

1. Controller

Agapov Production, trading as AGAPOV & ARNO, Seestrasse 264, 8700 Küsnacht, Switzerland, is responsible for the processing described here. Contact: hello@agapovarno.ch.

Swiss data-protection law is the baseline. The EU/EEA GDPR applies only where its territorial scope is met; merely visiting this Swiss website from abroad does not by itself determine that scope.

2. Data we receive

Depending on how you interact with us, we may receive contact and inquiry details, session and participant information, uploaded references, booking and payment records, correspondence, newsletter choices, photographs and project files, and technical information generated when the website is used. Please do not send unnecessary sensitive information through a website form.

3. Purposes and legal bases

We process data to answer inquiries, prepare and perform sessions, deliver galleries and files, administer contracts and payments, keep legally required records, secure and operate the website, and defend legal claims. We process newsletter data only after an affirmative subscription or another narrowly applicable legal basis. Where consent is the basis, it can be withdrawn for future processing. Other processing may be necessary for a contract, required by law, or based on a proportionate legitimate interest.

4. Public forms, CRM and communications

The Session, Contact and Subscribe forms are provided through Wix Forms. Submissions are stored in Wix Forms and, where contact fields are mapped, in Wix Contacts/CRM. Active Wix Automations notify authorised A&A collaborators by email about new submissions. Session category and selected package may be stored with the inquiry. Marketing attribution parameters are stored only where a supported form field and the disclosed purpose permit it.

The Session newsletter checkbox is optional and unchecked by default. The Subscribe form requires an affirmative checkbox. A session or contact inquiry does not itself constitute newsletter consent. You can unsubscribe at any time using the message link or by contacting us.

5. Website platform and processors

The website, forms, contacts and automations run on Wix. Wix may process technical and operational data needed to deliver, secure and monitor the service. The current Usercentrics scan also identifies a Wix Sentry endpoint used for operational error monitoring; it is not an A&A advertising pixel. Depending on the service requested, authorised providers may also include Google Workspace/Drive, email, cloud-storage, payment, gallery, delivery and professional production providers. They receive only the data reasonably required for their role.

Service providers may process data outside Switzerland. Where required, we rely on an applicable adequacy decision, recognised contractual safeguards or another lawful transfer mechanism. We do not describe a vendor as active merely because the platform can support it.

6. Cookies, Usercentrics and Google Analytics

The consent banner is supplied by Usercentrics for Wix. Essential technologies operate where necessary for the site. Functional, analytical and marketing technologies are controlled according to the choices offered in the banner. You can reopen “Privacy Settings” at any time and change your choice for the future.

The site currently uses one Wix-native Google tag for Google Analytics 4 (G-E25LC07LPR). It is intended for aggregated website measurement and is operated in Wix Basic Consent Mode: analytical data is sent to Google only after the relevant consent. Advanced Consent Mode is off. Google Tag Manager, Google Ads and Meta Pixel/CAPI are not currently connected. If one is activated later, this policy and the consent inventory must be updated before use and any required consent must be respected.

This website does not maintain a separate Cookie Policy page. The current technologies and choices are described in this Privacy Policy and in the live Usercentrics Privacy Settings panel.

7. Social media and external links

The site links to Instagram and may link to other external services. Opening an external service is governed by that provider's own terms and privacy information. An ordinary link does not mean that an advertising pixel from that provider is installed on this site.

8. Photographs, galleries and retention

Client galleries remain available for exactly 90 days after delivery. Project files are normally archived for up to 12 months, without a permanent-storage or recovery guarantee. Other personal data is retained only as long as reasonably necessary for the stated purpose, contractual administration, security and legal retention or claim periods. Data is then deleted or anonymised where appropriate.

Photographs may contain identifiable adults or children. Portfolio, marketing or publication use is handled separately from service delivery and requires the applicable permission or another valid legal basis. A parent or legal guardian must authorise the participation of a minor.

9. Security and access

We use proportionate organisational and technical measures and restrict access to people and providers who need it for the relevant purpose. No internet or storage system can be guaranteed completely secure.

10. Your rights

Subject to applicable law, you may request information about your data and ask for access, correction, deletion, restriction, portability or objection. You may withdraw consent for future processing. Identity verification may be required. Swiss complaints may be directed to the Federal Data Protection and Information Commissioner; where the GDPR applies, a competent EU/EEA supervisory authority may also be available.

11. Updates
